History.
1937 January 18 - Fred A. Walls of Southwest Harbor sold to the United States of America a parcel of land containing 150.5 acres “more or less” (Hancock County Registry of Deeds book 655, page 274), but “[e]xcepting and reserving a cemetery lot of one hundred feet square which is situated on the north side of the Town Road, bounded and described as follows, to wit: Beginning on the southeast corner of the said cemetery lot which is one thousand three hundred and fifity feet northwesterly, by the said Town Road, from the southeast line of the above described property [i.e., the property from which the cemetery was excepted]; thence one hundred feet northwesterly by the road; thence one hundred feet northeasterly; thence one hundred feet southeasterly; thence one hundred feet southwesterly to the place of beginning.”
2010 August 10 - The Town of Tremont acquired the above-described cemetery (book 5461, page 118): “I, Millard Billings, in my capacity as Town Manager of the Town of Tremont, duly authorized; hereby confirm: All in accordance with Title 30A; Section 3107 the Town of Tremont, after having advertised its intent to acquire the hereinafter described abandoned cemetery as required by the Statute and has performed the due diligence also required by said Statute; and having received no objection to said acquisition; has thereby acquired the following described abandoned cemetery in said Town of Tremont:
“The so-called Kelley Cemetery in said Town which is bounded on the South by Seal Cove Road; on the East, West and North by and of the land of the United States of America; as defined as an exception in a deed dated March 2, 1939 from Fred A. Walls to the United States of America and recorded in the Hancock County registry of Deeds in Book 655 page 274.” [Note: “March 2, 1939” was not the date of the deed. Rather, it was the expiration date of the commission of Charles J. Hurley, the Notary Public before whom Fred A. Walls appeared when he signed the deed. The deed was signed on 18 January 1937 and was received and entered that same day by George R. Hadlock, the registrar.]
